1. Acceptance of Terms

By accessing and using I Spy Ice ("the Platform"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Platform.

2. Purpose and Intended Use

I Spy Ice is designed to enable community members to report and visualize Immigration and Customs Enforcement (ICE) sightings. The Platform serves the following purposes:

  • To provide timely information about ICE activity in communities
  • To help community members make informed decisions about their safety
  • To document patterns of ICE enforcement activity
  • To facilitate community awareness and mutual aid

3. Legal Implications and Responsibilities

You understand and acknowledge that:

  • First Amendment Protection: Reporting ICE sightings is a legal activity protected under the First Amendment right to free speech and the right to document public officials performing their duties in public spaces.
  • Truthfulness: All reports must be truthful and accurate to the best of your knowledge. Submitting false reports may have legal consequences.
  • Non-Interference: You must not interfere with law enforcement operations while gathering or reporting information.
  • Property Rights: You must not trespass on private property to gather information for reports.

4. Appropriate Content Guidelines

When submitting reports, you agree to:

  • Only submit content directly related to ICE sightings and activities
  • Avoid submitting offensive, harassing, threatening, or inappropriate content
  • Not submit content that violates any local, state, or federal laws
  • Not submit false, misleading, or deceptive information
  • Not submit content that infringes on intellectual property rights
  • Respect the dignity and privacy of all individuals

The Platform administrators reserve the right to review and remove any content that violates these guidelines.

5. User Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Attempt to gain unauthorized access to the Platform or its systems
  • Submit spam, duplicate reports, or abuse the reporting system
  • Harass, threaten, or harm other users or individuals
  • Impersonate any person or entity
  • Collect or store personal data about other users

6. Data Collection and Privacy

The Platform collects minimal data to function effectively while protecting your privacy:

  • Location Data: GPS coordinates are rounded to approximately 11 meters to protect precise locations while maintaining usefulness.
  • Device Identifiers: Hashed device identifiers are used for rate limiting to prevent spam, but cannot be used to identify you personally.
  • Optional Content: Notes you choose to submit are stored and may be publicly visible after admin approval.
  • No User Accounts: We do not require user accounts, maintaining your anonymity.

7. Report Approval Process

All submitted reports undergo an administrative review process before appearing on the public map. This process helps ensure data quality and prevents abuse. Administrators may approve or reject reports based on adherence to these terms and content guidelines. The Platform does not guarantee that any particular report will be approved.

Permanent Public Record: Once approved, reports become permanently visible to the public and cannot be deleted. Please carefully review your submission before confirming, as you will not be able to remove the information once it is published.

8. Intellectual Property

By submitting content to the Platform, you grant the Platform a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, display, and distribute your content for the purposes of operating the Platform. You retain ownership of your content.

Important: Once your report is approved and made publicly visible, it becomes part of the permanent public record and cannot be deleted or removed. Other users and third parties may view, copy, archive, or redistribute the information. By submitting a report, you acknowledge and accept that you cannot request deletion of publicly shared data.

9. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties regarding the accuracy, reliability, or completeness of reports
  • Warranties that the Platform will be uninterrupted or error-free
  • Warranties regarding the security of data transmission

10. Limitation of Liability

To the fullest extent permitted by law, the Platform and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Platform, including but not limited to damages for loss of profits, data, or other intangible losses, even if advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Platform and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these terms, or your violation of any rights of another party.

12. Changes to Terms

We reserve the right to modify these terms at any time. When we make changes, we will update the "Last Updated" date and require you to accept the new terms before continuing to use the Platform. Your continued use of the Platform after accepting the updated terms constitutes your agreement to be bound by the modified terms.

13. Termination

We reserve the right to terminate or suspend access to the Platform for any user who violates these terms, without prior notice or liability.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
